Life sucks sometimes.And yes you can be fired unless you have a doctors note,in jail,or in the morgue.

It is likely legal depending on where you live. Termination is a possibility if an employee has been with the company for a short time, lives in a "Right to Work" state in the U.S., signed paperwork stating that either the employee or employer may terminate employment at any time, or has multiple documented instances of poor work or insubordination. For long-time employees with good work records, there is the possibility that a law suit could be filed for wrongful termination which makes firing less likely.
Many people work holidays (including Christmas) in hospitals, police and fire stations, convenience stores, radio and television, call centers, nursing homes, and assorted other workplaces. Some employers pay a higher holiday wage, and/or take volunteers before scheduling Christmas day staff coverage. You can ask your employer about the possibility of shorter work hours if business is slow that day, and it likely will be!

Your employer probably wouldn't fire you and state it's because you're calling in sick - even if the law allows it, "employee fired for spending christmas with family" as a headline would cause enough bad press that he wouldn't risk it. Most likely, he'd just remember it and get you next time you slip up with something - which we all do from time to time. Or if you desperately need time off or a favour or a bit of sympathy from him next time, you can forget about it.
If it's a career type job, don't risk making an enemy of your boss. Clearly he needs the manpower for some reason. Either way, using the law or a doctor's note to get the day off (which he'll know you're doing even if he can't fire you for it) is basically saying that you'll do the minimum that's required of you and that's that, it's basically a mocking middle finger to your boss, saying he can't touch you. Unless it's a job that you don't see yourself being in for much longer anyway, or is easily replaceable, I'd say just suck it up and take one for the team. People are very good at remembering bad things about other people.

I don't your nature of job.In some jobs.....Sunday/Christmas/New Year etc......all are working days.How can a Hospital run if all are absent on these days.Same is true in cases like; Municipal/Corporation work, the Transport system of any country(Air/Rails/Road transport must run on all days.Please don't feel bad about it.Take it in your stride.It may be you are in a job where presence of all needed on even on Christmas Day...../or, it may an unusual situation and the Boss has no choice , but, to insist on everyone's presence in the working place even on this special day.

There are many jobs which must be done, the old folks don't stop needing care in the homes just because it's a holiday. I used to wear a Christmas vest or some fuzzy antlers or a Santa hat on the holiday when it was my turn to work.

IF you were really sick and IF you could find a doctor to give you a sick note then your employer wouldn't have much option but to accept it.
How would you feel if everyone went sick on Christmas Day?
Policemen, firemen, nurses, soldiers in the Gulf etc etc.

As far as I know it is legal...Hey, I know it's awful working on Christmas. I have to work Christmas this year...just look forward to the extra pay, if your employer pays you time and a half.
Hang in there, it's really not quite as bad as it seems.

ur employer can do anythin wid ur job becoz ur workin under him n u cant question him becoz hes payin n u r workkin for money
my idea is that request him once again in a good frenly manner if he doesnt thn i dont kno
but if u want a holiday resign da job serch for a new job after christmas
hope ur employer gives u a holiday!!!

You can't be fired for missing work due to genuine illness.
But there's no law that says you don't have to work on Christmas day (if hospitals weren't open on Christmas day there'd be nobody who could give you a doctor's note to explain your illness...)
