The Pats lose their Original pick not the one they traded with the 49ers.
and as much as i would love to have McFadden on the squad he will not be drafted by the Patriots.
the Patriots biggest need is Linebacker since most of them are getting older and slower.

It's the original one. It is DEFINITELY *NOT* the SF pick. The commish said that if the Pats missed the playoffs, the penalty would be their 2nd & 3rd round picks INSTEAD of their first rounder (so they never would have lost a high round pick due to this)...
For figuring out the draft order the first tie breaker is strength of schedule. So if the 49ers & the Jets end up with the same record, whoever had the weakest schedule gets the 2nd pick.
And there's no guarantee that the Pats will use that high pick themselves. It would seem to go against the teams salary structure to tie up so much money in a rookie player unless the player was GUARANTEED to be successful. And how many high picks have earned that money?

im pretty sure they will forfeit their lower pick and stay with the SF pick they have for obvious reasons. Plus, i dont think the NFL said a specific pick will be taken, just a 1st rounder.

I dont know about McFadden falling with the Pats. They play the Jets which is a gimme realisticaly. SF will win one more game at least in the looks of it since their last 3 games are going to be with Inconsistent teams - Browns, Tampa, Bengals.

They lose #32 after they win the Super Bowl...The other first round pick was from a trade with the 49ers...They already had it before the camera thing...

They will lose their respective pick because it was theirs. They acquired the other one in a deal with San fransico in which San Fran received Joe Staley in exchange for their first round pick.

yeah, they are going to forfeit they're original pick...i think they will end up with Darrick Mcfadden at # 2.
