*My spouse lives like a single person when he is not at home. He gets strange phone calls and text messages. He has a bad temper and says he does not care about any of us and does not want to be here. He will frequently attack at least one of the children physically and all of us verbally.
*He has not asked for divorce. When I ask him about it, he denies it. I think he is just plotting his way out.
*Many of my personal belongings have disappeared. I think he gave them all away.
*I want to leave before the stuff hits the fan. I don't want to be surprised and left with nothing and nowhere to go with a bunch of kids.
*I think I have about 3 months according to his behavior.
*Can I just leave, take every stick of furniture/appliances/hardware, etc. left in the house, serve him with divorce papers, then demand that our house be used for rental property and extra income or should it be sold, or should he buy me out? What's best?
*Where to find a new low cost rental home for 5

If your state is a community property state, and you bought the house together, they you both own an undivided share of the house. Since you can't rent half a house, you will need to get your husbands cooperation to lease the property. From your description, it doesn't sound likely that he will cooperate.

If your spouse really does what you say, you need to contact the local district attorney and file a criminal complaint against your husband for child abuse. You could go to children's protective services, but I would be careful. They might just take the children and leave you to deal with your husband.

Your best shot is to call the police the next time he hits you or your children, and have them intervene. Do this several times and you will build a case against him to have him ordered out of the house.

One other thing. Look in the phone book for the local women's shelter. They can probably give you a phone number for a free or low cost attorney.
