My roommate tried to get something i was holding in my hand but it had a big snap hook on it so he pricked my palm. I had to go to hospital and total bill for this "accident" is $4300. I dont have any insurance and I can't afford to pay 4000 bucks - roommate says he won't pay anything so I'd like to know what should I do now. Thanks

Short version: I was injured by my roommate. Can I sue him for $4300 (medial bills) or I have no chance?

You are responsible for the medical bills. But your roommate committed a tort against you for which you can sue. See an attorney, then let him know if he doesn't pay up, then you'll sue. Any judgment you get against him could follow him for years.

If he was trying to take something from you that you did not want to give up, it could be considered assault and possibly attempted theft. You could approach it from that direction by filing a criminal complaint against him. It will not get you any money but it will make his life miserable. You will have to move out to make it appear you are scared of him and of possible future assaults. (Kind of dumb)

You might file a claim against him in small claims court. Most have a maximum of a few thousand of dollars. You can get him there and he will end up paying perhaps half of your medical bill. Got any witnesses? Got enough to pay for your room yourself since he will probably more out.

If it was a prick, what did you need to go to the hospital for?

If you had gotten renters insurance, it probably would have covered a small claim like that.

Well, since HE was the one reaching for what you had, I suggest going to small claims court as long as $4300 is not as much as you statutory maximum (the maximum amount you can sue for in small claims courts of your state) You might also be able to sue for pain and suffering.

How the hell does THAT turn into a bill for that amount? Do you have homeowners insurance? This could possibly qualify under the medical portion of that policy if you have that. Otherwise, I think that you are responsible for your own actions.

What you should do is vote for barack oboma. He's for free universal health care. Vote or die...or maybe just pay out the *** for medical bills.
