It is my understanding that it is still technically illegal to be a member of the Communist party in the USA. The reason for this is that the Communist Control Act of 1954, signed into law by President Eisenhower, was never repealed and never declared unconstitutional by the Supreme Court. However, the party still exists, no administration has enforced the act, and a Federal district court declared the law unconstitutional. (As mentioned, the law is technically still on the books).

Agreeing with communist goals isn't illegal in the US. Those kinds of laws, when they get passed, are never very long lived. They wind up losing to constitutional challenges.
I think the last time any such law was even enforced was probably around the time of WWI. (Against "anarchism".). There were laws passed in the 1930s attempting to make union support illegal, but that's not a support or opposition to Communism. Even so, those laws were also challenged and struck down. (Most of them, anyway).
As far as government action is concerned, however. Yes, the government seizure of private property without due process and without demonstration of overriding state interest is barred. But the bar is on the government's actions.

There is no law in the US that makes it illegal to be a member of any political party or to believe in any ideology.
Laws have been made at times which tried to make communism illegal and jail communists, but those laws have been ruled to be unconstitutional, as the first amendment gaurantees freedom of speech and implies a freedom of conscience, that is a freedom to believe whatever one wants.
There are laws against advocating the use of violence to overthrow the government. But communism does not advocate the use of violence except in self-defense.
There are several communist parties in the US, and while none of them are very big, there are probably more members than most people suspect.

It never was illegal. If an American citizens wants to, they can register to vote as a Communist. The Communist party in the USA frequently runs candidates, but they have such a small following that I doubt they win any offices.

It has never been illegal, the communist party has run in every election since the 1920's. Its true that communist sympathizers have been hurt by their support in show business and politics, but the party has never been illegal.

haha, that doesn't even make sense. Communism is a form of government, America happens to be a democratic republic. However, there is a communist party and commies that run for office, they just never get elected.
