Your wife is entitled to half of ANYTHING acquired during marriage. Money, retirement, houses, cars, any assets. She doesn't have to sign the papers before she goes to court, she can go without a lawyer. Someone also needs to tell your wife she can probably get an attorney that will work for part of the settlement. You're lucky she doesn't want half of everything. If she was smart she'd get a lawyer, she'd ask for ALL assets to be sold and ALL money split in half.

Why are you trying to cheat your wife anyway? You may be getting a divorce, but she was there and supported you through life. She would STILL be there for you, if it wasn't for you wanting a divorce. She deserves to get something out of it. I feel sorry for her. My husband gave me EVERYTHING when he asked for a divorce, because he knew I didn't want one. He took his car, his laptop and his clothes.

The more you argue, the more money it will cost you on both sides. If you can come to an agreement it will be much easier and the divorce can be completely over with in less than a month if all sides agree on what the papers state and they are signed and turned into the court.

What papers are we talking about and how is she gonna be forced....is someone gonna hold a gun to her head?

She doesn't have to sign anything she doesn't want to, with or without a lawyer ...her refusal will not prevent a divorce.....it may prolong it....the judge grants the divorce and he must follow the state laws in divison of property...he may have some wiggle room but not much......and any agreement/demand as to division of assets he must approve of reguardless even if both agree.
If you live in a no-fault divorce state you don't need her permission/co-operation. In a fault divorce state you need ligitimate grounds (NY is a fault state) . If your complaint isn't considered a divorcable offense, you are out of luck.

Depending on how long the marriage lasted she is entiltled to a portion of your retirement funds and S.S.benefits.....and in many states one half of all assets deemed marital property......and here again your state & the judge decide what is marital property, not you or your wife.

No one can be "forced" to sign anything against their will. If your wife cannot hire an attorney, she will represent herself in court. And don't think that the judge will let you (or your lawyer) get away with anything that is against the law. If your wife is legally entitled to half of your retirements, then she will get it whether she has an attorney or not.

If she is still your wife and she can't afford to pay for an attorney then you will most likely be responsible for paying for hers. A marriage is financially split 50/50 in most states. You better think before you leap.

Attempting to have her forced to sign papers, what are you thinking?

She doesn't have to sign a thing. And, since you're such a lovely ex-husband-to-be I would be using YOUR money to get a lawyer and I'd take you for retirement money and then some. Why can't you just be fair?

She can't be "forced" to do anything.

For the two answers above me, there may be very good reasons why the retirement should or should NOT be split up so be nice!
