he has a lawyer to represent him, he works under the table, just got remarried for the second time. I work 32 hrs per week and am CP. He has not paid support in over 4 months, claims he doesnt have it ~ but he can afford a lawyer for $215/hr and to pay for part of his wedding. He did have back surgery in August and wants to use a medical excuse for not being able to work to pay support. Court is asking for 2 yrs of tax returns. I am concerned about the outcome. This support helps greatly when its received, what will I have to prove in court? Thank you for your input here!! (FYI, we never married, relationship ended in domestic abuse)

Tell him that if he is going to file for lowered payments you are going to the IRS and report him for non payment of taxes or to get them to analyze what he should be making and report the company for not withoulding proper taxes from his pay check. perhaps that will end that. You can probably get an attorney from legal aid and it won't cost as much and if you have any proof that he is working under the table you may be able to demand that the amount be taken into consideration by considering how much a person in that field should expect to make per hour times 40 hours a week. This could be a little tricky for you, because there's no real way to prove that he works under the table. They won't give him any less than minimum wage, but if the support order say he's making more than that, then it could get lowered.

Is there any way that you could get a lawyer, because you might need one (unless the support order says he's not making much more than minimum wage). If you can't get one, just be sure to point out that he had the money to get a lawyer and pay for a wedding.

You and your lawyer need to spring for someone to go out and get PROOF that he's getting paid under the table. That will kill his request FAST.

You and the court can ask him to show how he pays to live and drive a car and eat if he "doesn't work". You can subpoena his (and her) bank records to show deposits and checks being written to show income. If he is hiding money in her accounts it will be very easy to figure out.

u just have to prove you need help with "yalls" child prove you work 32hrs or more and he will have to pay back child support
