No there's not. There's not always a clear cut situation in which one can define a winner and loser. There are often Win/Win and Lose/Lose situations where the "winner" is the one who gains or loses the most or least -- I hope you understood that. I love your Questions. It always depends on the angle you look at things. From a win/lose perspective, yes, there is always a winner and a loser since there can only be one winner. From a win/win perspective, there are no true winners, all parties involved gain something in the process. From a lose/lose perspective, there is not a winner and all parties involved lose time and energy in the process.

Only in sports and games with rules. In real life it isn't always so black-and-white.
A person who may be perceived by others as a loser can feel like the biggest winner of all; it's a matter of perspective.
