I athought that in the Guidelines somewhere it stated that the Non-Custiodial Parent had to provide the children with a bedroom and a bed to sleep in. We have a 12 year old boy, an 8 year old daughter and a 5 year old boy together. He lives in a two bdrm apt and the 2nd bdrm was for our children. He got a roommate and gave that 2nd bdrm to the roommate so now our children have to sleep on the floor. Am I legally bound to still make them go over there every other weekend because of this?

His bed is a Waterbed and he suppousdly did not know he could not have that while being in an upstairs apt. RIGHT!!! Common Sense!!

You can easily petition the courts for a modification until he changes his living arrangements.

Bull hockey! My ex has a one bedroom apartment, and when my children go over there for visitation he gives up his queen sized bed for them and he sleeps on the couch. It's the only right thing to do! Unfortunately, you are legally bound to bring them over for visitation if that's what your court order states. If it states that he is to have a bed for his children, then you should call your lawyer and explain what's going on.

He does not have to provide a bedroom for each one but he does have to provide a bed for them. Even if that means that he has to put one of those full/single bunks in HIS room. Your daughter needs a bed (the single top bunk) to herself. Check with your local social services to see if there are any other restrictions.

you do not have to let the kids go over there... you are correct, no child over the age of 5 should share a bedroom w/ their parent, and they should not be in the living room, either, no door means no privacy... take him to court... good luck...

and they should not share a room w/ his roommate, either... =)

PERSONALLY, I think he should give up his bed so they don't sleep on the floor... I understand why he got a room mate, but come on... PUT THE KIDS FIRST DANG IT!!!!
