My neighbor has 2 pit bulls that he lets roam all over our street (rural Texas=no leash laws).Chase people walking (has chased my husband, me and my 6 and 9 year olds down the road in front of our house), horse riders and other animals. One dog is nice, the other is very aggressive and has come up to my back porch and attacked my cocker spaniel with my kids only 5 feet away, and the owner had to physically remove his dog from my property. I have called police numerous times and they say i have the right to shoot the dogs if i feel threatened, but I hesitate to do this, as the owner is very violent. The dog chased my sister in my yard today and my brother told the owner (who watched the whole thing) that he was going to shoot the dog, and the owner started screaming that he would kill all of my dogs and that he would kill my brother as well. we called the police and all they did is go talk to him and tell us to shoot the dog. Can I sue this man or do I not have any rights at all?

Get some of that on video! Don't ask the police to help just go tot he PD & press charges. He may be violent but he's not stupid is he? Once he sees you absolutely mean for him to keep the dog out of your yard & away from your kids and pets or face charges he might take you more seriously! I can't poison an animal myself I just can't do it! I do think I could shoot it if my family or pet was being attacked but I now you don't want it to go that far right! Don't be afraid of the man just simply and matter of factly tell him that you are prepared to protect your family and pet whatever it takes just like you would expect him to do for his own family and pets! So if he cares anything about his dog he should take precautions and restrain him.

If you do, and you own the property I would suggest that you spend the money and fence the yard to block the free access to all unwelcome animals and people. If I was in your situation and didn't own the property I would consider moving, or if there were other issues and I owned the property I would consider selling. Living next to this unreasonable neighbor is putting you and your family in harm's way. Obviously, calling law enforcement isn't solving your problem.

Please do not heed the advice in other answers to harm any animals. It's not the animals fault and you won't be setting a good example for your children of what to do. If you have an attorney or know of a friend that can recommend an attorney you could probably get a consultation for free of your rights.

Another option would be to consider calling animal control repeatedly and see if they will pick up the pit bulls if they are unleashed and roaming. After a few times of having to go and pick up the dogs your neighbor might get a clue.

I have a pit bull myself, she would never harm a thing enless something was happening 2 me or my daughter. But like u said its just the one, which is very upsetting. i don't believe u can sue enless anything happens(which i hope doesn't). i would get a fence. but if it comes down 2 it, u have 2 protect your family.

don't waste time to call the police...just give the dogs some "nice" hamburgers and the problem will go for ever...we did it years back to someone that have the same situation.
