Could someone please explain in simple terms the legal basis for making someone who instigated a murder, eg Charles Manson, guilty of murder? I should imagine it is based on English/American Common Law.

Criminal solicitation to murder or conspiracy. Remember , the solicitation merges with the Conspiracy to murder. So if Manson urged, encouraged, eniticed, incited,counseled or hired someone else to committ murder , the solicitation would be punsihable as a Felony just as the conspriacy would. Conspiracy to murder is punsihed the same as if Manson did it himself. Remember under PINIKERTON. V US all co-conspirators are vicariously liable for the acts of other Co-conpirators. Instigating a murder is punishable because it is indispensable in the commission of the crime.
