A friend of mine and I work at a restaurant that we can tell is going under. In the month and a half I have worked there I have only received cash as payment and I am sure it was not enough. They do everything manually, with handwritten time cards and handwritten everything else. I am sure that they have not filed with the IRS for me because they have not requested a W-2 form. So I do not believe they are even taxing my wages. My friend has worked there 2 months and only received 2 paychecks. Only one was actually a check though. Employees are walking out left and right and our employer is avoiding us completely. We all want our wages though. Is their a legal way to get us all together in a class action suit against our employer to force him to pay us?

You don't need a class action. Together or separately you can contact the labor department, wage and hour board. They will see that you get paid or they will close the business.

Yes, It's not only a State matter but Federal as well, every employee deserves to be paid the number of hours they've worked. Try contacting the Department of Labor or your State.
