Is it illegal to write a check to someone and then cancel it before they cash it?

Its a check from Illinois written and given in California. The person who wrote it was blackmailed into writing it by her grandaughter and we told her she should call her bank and cancel the check.

If you intentionally plan to defraud the person or company, then yes.

There are reasons to cancel a check. If you find out that the party the check is made out to is acting in bad faith, then you can cancel the check.

Depends. If it was to buy goods, and you knew at the time the check was written, that you were going to stop payment, yes, that was fraud and a crime. If you did it because you did not get what was promised, then it is civil.

One exception. If you wrote a bad check, and then stopped payment because funds you thought were coming, yes a crime has been committed.

If this is blackmail, you need to call the police and put a stop payment on the check.

it depends on the state and the situation. it is not legal for a person to stop payment on a check for services rendered here in nevada

She can be sued for the amount but by taking it to court she could explain the reason for giving the check.
