Yes, the LL can still begin eviction proceedings as long as you did not pay the entire amount. If you are a habitual late payer, the LL can evict you based on that alone. If that is the basis for the eviction, it will not matter if you pay the entire rent.

First every state has different Laws governing landlord tenant laws. Basically in Calif. If a landlord excepts a partial payment with the promise to pay later. They must allow you that time. If you do not pay within that time you will receive a 3 day notice to pay or quit.

He can't just kick you out, he needs to get a court order. However, the answer is yes. Your contract calls for a certain amount of rent due on a certain day. If you don't pay the full amount in a timely manner, then you are in breach of contract.
Only a jerk would do that though.

depending on where you live and the laws there, he can. Although with a verbal contract it makes it more difficult. If you're in Canada, then you cannot be kicked out between december and march, due to the harsh winter conditions. Nor can they turn off your heat and hydro if you fail to pay them. Read up on your local Tenant's act, and see what it says.

If the landlord accepts the partial payment..he then accepted the terms and changed the rental agreement verbally...if he didn't take the money then he would have leg to stand on...at least in California.

he cant "kick" you out...he has to either get the law to come and remove you (if he has the lease agreement and it states he can immediatly evict you), or go thru the courts....but if you have something written that he said he would take a partial payment, you're cool.
