The President has absolutely no power to "make war" That act is alone given to Congress by the Constitution.

it is restricted by the War Powers Resolution Act, introduced by Congress in the 70's.

but the President can still declare war as he is commander-in-chief

Yes and it already is... that is why there is all the hoop-la about Congress giving Bush the authority to invade Iraq... he couldn't have done it without that resolution.
