Sure you can. The Immigration and Customs check-point at the border has video of your car coming back from Canada along with the exact time and date. Get an attorney to represent you and he'll/she'll subpoena the the tape. You might even see if the bar tender / waiter/waitress at the bar in Canada remembers serving you and get that person to appear as a wittiness.

Doesn't matter.

In the US, if you are not of legal drinking age, this means that you can't be in this nation with any alcohol on your breath. If you have been drinking in Canada, you need to remain in Canada until you can blow a 0.00. Otherwise they can get you for underaged drinking.

If the driver wasn't drinking they cant legally give a breathalizer to anyone else in the car. At least thats how it is in MN, and therefore cant really charge you for anything or prove that you were drinking

Libertarians do no longer unavoidably have an argument with age of consent rules, however. the concept you ought to attain the age of consent to drink, smoke or have intercourse isn't counter-libertarian and is, in reality, an important component to settlement regulation. A consent-based society desires to have some definition of who can consent and what constitutes consent as a manner to mediate disputes. That being pronounced, i think of the ingesting age is purely too severe, and no less than it is going to be consistent with the age of adulthood.

Tough one, I don't really know. All I do know is that you shouldn't ever consent to any search without probable cause. AKA breathlizer, sobriety test.
