I came home from 10 days away to find a fixed penalty notice on my windscreen for a one day temporary restriction that had been in place.Through my letterbox was a letter from York council giving only 7 days warning of the restriction.I do not feel this is fair.Is it legal?

just prove to them you were away..e.g. credit card bill etc or if you booked a flight even better.. contest it.

i thought you had to give 14 days notice... get off to ya local citizens advice beaurnu

motorists get stung for everything these days, petrol , high insurance etc. .getting fed up of it

It is legal, they have complied by giving you seven days notice of the temporary restricition. They cannot be expected to know you were away on holiday.

However contest the ticket on that basis, as long as you can prove you were away and could not have recieved the notice warning then i cannot see why they would require you to still pay the fine as you had a reasonable excuse for ignoring the restriction and leaving your vehicle there not knowing about it.

But you may have to go to court to argue this.

How can it be fair if the 7 day warning was sent to him in absence?! Screw them I'd contest it all the way, you can't be penalised for something you didn't have notice of so I'd gather all your evidence of having been away and present it to them

It's a traffic fine. Go to court and tell your story. The judge might let you off.

You'll have to check your local notice laws to find out if it's actually legal.

your lucky they didnt tow it and crush it, same happened to a girl on tv the other night and the crushed her car.
If you can prove you were away for the period then they have to revoke the ticket

yes...not their fault you were away....they warned you in advance....but i would argue the hell out of it if i was you.
