so basically one of my best friends, me, and other friends were over my best friends house, and well,my best friend decides to scare us and throw a firework, so we all run away, and one of the girls, jumps up herself and supposedly breaks her ankle,and has to go to the ER.

she doesnt have any insurance.

so now shes planning to sue my best friend, isnt that ridiculous,and she refuses to pay medical bills.

and get this, her family got evicted from their home, her father spent all their money on drugs. and her parents are losers who dont want to work,but the girl, keeps herself in good shape and you wouldnt think her families like that.

but, shes greedy. and definetely was a FAKE friend. she lost so many friends from this.

This hapened about 4 months ago, and i guess we havent heard much from the case,but recently we just heard shes trying to sue for $10,000.

Who do you think would win the case? This was an accident. and shes sueing very much.

error i made above. she didnt exactly throw the firework. We were all sitting in a circle. and she tossed it on the middle. she didnt neccessarily throw it at anyone.

Your best friend--he/she is responsible for any damage or injury caused to another place or human being. If he/she refuses to pay the damages and medical expenses then the injured girl can sue under the coverage of your best friends--he/she's parents home insurance coverage. She can also look for punitive damages that can amount to three times as much as the medical expenses plus any damages the court allows--such as legal expenses etc. It would be advisable for your best friend--he/she to attempt to make restitution before the person injured gets some good advise from a good lawyer. good luck

No, it's not ridiculous at all.

Why should she have to pay all her own medical bills because some knuckle-dragging moron decided to throw a firework. That's not an "accident", it's stupidity, and we are legally liable for the financial consequences of our own stupidity.

Your friend needs to step up and take responsibility for his actions. It's disgusting that he left a friend to pay all that money herself unless she sued him.

The "fake friend" here is the idiot who threw the firework and now won't face up to his responsibilities. Sounds like she's had a bad start, but is doing her best, and now your best friend is trying to mess her over.

Let me get this right; your best friend thinks that it is funny to light a firecracker, in a house, with other people around. A girl breaks her ankle trying to escape and you think it is her fault that she broke her ankle. HMMMM! the idiot that lit the firecracker should pay---gosh, that was a no brain-er!!
Does she have a right to sue--you bet
Will she win--probably
Is this person that lit the firecracker right in the head--probably not
Will homeowners insurance pay her medical--probably
Does the idiot that started all of this deserves to get off free of charge--NO

Honestly, from what you described, her hurting her ankle was an accident, but your friend that threw the firework was his decision to do, and with every decision, good or bad, that is made, there is a consequence, good or bad. Sorry dude, it doesn't look good for your friend.

Sounds like she has a case to me. In my opinion, the friend to lose is the one throwing fireworks at people.

Accident, my ***. She should sue,for not only med but for pain and suffering and with the right lawyer, she's get it.
