Contractors dug up our road on behalf of Thames Water. The day after they blocked the road due to heavy plant and machinery being present my car parked got a lovely bump on it. Spoke to foreman said it might have been them - but subsequently denied. As contractors did not put up signs informing other drivers of this temporary block to access - cars and lorries were performing 3 point turns all day. This is where I think the bump may have came from.

Even though the contractors say it has nothing to do with them I am sure they have breached a duty of care and I can still chase this with them. So far they have replied to one of my letters saying nothing to do with them - the other letter was not replied to!

Any ideas would it be possible to threaten legal action or am I justing wasting my time?

You can threaten legal action all you want - the threat will not mean anything to them and it will not scare them. They have been down this road too many times - do you think you are the first to try to blame them for damage to your car? Nope.

In order to prevail in court - you have to prove that the construction company caused the damage to your vehicle. Can you do that? Sounds like you can not. Therefore, you would not win. The construction company knows this. They have the financial resources to higher an attorney and fight it in court.

If a driver making a 3 point turn caused the damage - that is who you pursue -not the construction company. Since you don't know who that driver is - you have no other course of action.

Just turn the claim into your insurance company. If you have the appropriate coverage on your policy, they will be able to pay for your damage less any deductible.

Since you don't live in the USA, I am not sure of your laws but here the city or county commissioners or dept. of Transportation which is state could be contacted to see who hired this company to do the road work. They certainly are remiss in not posting the appropriate signs and perhaps your local governing body could give you the information you need as to who is in violation and responcible. However, the one glitch is , you didn't see it happen so there is no proof as to when it happened in the eyes of the law. For all they know you could have had the dent for a week , done it in a shopping mall parking lot. Good luck
