I asked for the divorce, HIS attorney sent the Settlement Agreement to my attorney. I have signed, but now my ex wants to go for custody instead of him OFFERING and AGREEING that he is giving ME primary residential and HE asked for and I agreed that we would have 50/50 custody. He wants this all changed. Can he do that? (not getting a response from my attorney)

Not if he has also signed it.
It is not a valid agreement until both parties have signed it, AND the judge in the case has also signed it.

However, if he has not signed it, or it has not been approved and signed by the judge in the case yet, then yes he can change his mind and go for something different.

any agreement can be changed until the judge signs the papers after court, yes he can do this, more than likely he has found out how much he will have to pay. but if this is not about the money to either of you I would take a look at what is best for the kids. During a Divorce that is what should be the primary focus. put aside all diffrences and do what is right for the kids, if both parties can do that it is a win win situation for the kids.

He can do that, if both parties have not signed. After coming up with the papers, and having you sign them, I can see why you would be confused, thinking there should be no further steps in changing or altering said papers. I'd definitely consult your attorney though, because he is most likely the only person who would know what you can do about it. Good luck, I hope all goes well!

I agree with Trix above me. It is the worst thing to go through. He can try to change the papers since he didn't sign them. However, the judge would be more in favor of the 50/50 custody and if you are agreeable to it and he isn't the judge will most likely to favor you. I really wish you the best of luck.

not if two peeps sign it
and it goes thru the courts
and if your attorney agreed to it after it was changed, kick him in the balls and make him change it back

God Help you....I've been through it...it sucks...get ready for the worst ride of your life...Be strong...Don't talk about him in front of the kids Keep a Journal of every confrontaion you have with your X...Mine was 15 years ago..and it is a rough ride...you cn and will get through it...I wish you the best of luck...watch the amount of times you call your attourney...they suck you dry of $$$ I was blown at what he and I spent on our divorce and it was so long ago I can imagine what they charge for a phone call now...and they do charge...Good Luck...

Not without the one that signed it signing an addendum. Otherwise thats fraud as any lawyer will tell you(right before they try to pull it on you).

i believe the only way it's going to be changed is to go to court over it. there ought to be a court date for a hearing before the judge finalizes the divorce. you both will have to be there.
