Cary, North Carolina-Private school. My friend was texting in class and his phone was taken. The school said that they had the 'right' to read the text messages because they had taken the phone. Following this I was questioned by the administration, who didn't follow proper procedure found in the handbook, and I was told that 2 people had admitted that I had supplied them with cough medicine. I was suspended for the rest of the day and the following day and I came to find that no one had ever said anything about me they just went with what the texts said, but do keep in mind I did not supply anyone with anything. Would I have been suspended for Tylenol? So my question is even though I am almost 18 an its a private school, were any of my rights or my friends rights violated? Any of the amendments such as the First, freedom of speech, or the Fourth, protection against unreasonable seizures, even though they had reason to take his phone but not to read the texts.

OMG, a private school that is a communistic as many public schools. People aught to home school. You know, that type of education that teaches true history and facts about our constitutional Republic.

I think that they had the right to take the phone until end of class or end of the day, but they didn't have the right to go through it. If you were caught writing in a private journal during class time would they have seized and read that too?

If they have the right to seize the have the right to examine. If you believe your rules in the handbook were violated you can complain to a higher entity that is associated with the school. Damages are neglible and you can not really file a suit because it is a waste of time.

Taking the phone is fine seeing that you are not allowed phones in school, but reading the text messages is at the least unethical and should never have been done. Is it illegal, I don't think so, but surely unethical.. This is where the parents should step in and explain to the school that they will not tolerate this... Probably a good idea would have been to hand over the phone "MINUS the Sims Card" or the battery.

You and your friend knew the school rules prohibited you from texting in class.

If a teacher takes a hand written note - they can read it. An electronic note is no different.

Yet, you made the choice to do it anyway?

Hmmmm - sometimes actions have consequences.

And no - your rights were not violated.
