So if my husband and I buy a house next year and together take this mortgage, but I decide to leave/divorce him, who is going to pay it? If ofcourse I leave the house and he is going to continue living there...

He wants a house. He has the possibilities to pay the mortgage alone due to a good paid job. I will not.

If your name in on the mortgage, it is your responsibility to pay too.

The only way you can get out of it, is if your husband refinances and takes your name off the mortgage AFTER the divorce is final.

If that would ever happen than whoever is living at the house will have to pay for the mortgage. But are u having doubts with ur husband that ur thinking about leaving him. If u are u better consider it before u and ur husband make a big decision in ur lives on buying a house. that is a big step in a person's life. that doesn't look good on u if u guys buy the house and live in it for awhile and than say oh honey I'm sorry I'm divorcing u. SO u better think about it long and hard. Marriage is a lifetime committment unless a person is in a abusive relationship. Also if u leave him he might sell the house if he can't afford to pay for it on his own. So think long and hard on what u want to do.

When you both sign for a mortgage, both of you are held responsible for the payments, even if one does not continue to live at the home. The mortgage firm will not release you from liability simply because you divorced. You can divorce the husband, but you can't divorce the mortgage.

In other words, if your marriage is on the rocks, don't sign a mortgage now.

it would be the person that is living in the house. it sounds like you are planning on leaving him anyways though. if you are having doubts, i wouldn't even do it then.
