Unless ya'll are just renting from your Brother in Law, why would it be his house? If you and your husband bought the House "together" it is Both of yours. Now my understanding is, If your husband Owned the house "before" you married, it is not community property.

I don't understand the question. Are you married? If you're married then it isn't "your husbands" house, but both of yours. If you're divorced, why are you still living in the same house as your husband?
