different states for 12 yrs? I am working on my divorce, doing it myself. In all the papers & instructions I have read I have not found anything that says I do. But the courthouse wants me to bring in a paper called State Vital Statistics Form, when I read the instructions on it it was ONLY for those that have been legally separated 1st before getting divorce. I have known many people that did NOT file for legal separation 1st.

I live in Wisconsin. I got married in Wisconsin & have lived here the entire time. He left & went back to his state (Minnesota) 12 yrs ago. I have read everything that the court clerk told me to read for instructions when she told me what papers I needed. None of them said anything about needing to be legally separated 1st. I can not afford lawyer, that is why I am doing it myself.

When I got divorce from my 1st husband I married & divorced in Wisconsin & never had to file for separation. This is why I am confused with them wanting this paper this time around.

We live in Illinois and did not file for legal seperation first. It might depend on the state in which you resided when seperated or possibly married.

I suggest you call a lawyer in your area. File in the state you live in unless you moved there recently. Check out the settlement laws on estate and alimony for a fair deal. In Cali, for example, it's better, a 50-50 deal.
