Hey, I have a problem here I'll try to explain it the best I can. My father stopped paying child support when I was 16, he didnt work so they ended up taking it out of his disabilty I got a large sum of money, They would not give it to me becuase I was not 18 yet so my mom put it in a bank account with me as the beneficiary. I am now 19 now and she will not sign the money over to me. What options do I have to get the money?

As for all of you saying it's for my furutre, yes it is. but there was a court order along with it that says once the minor has turned 18 he shall recieve the money.

Support money is for the parent to have income to take care of the child. It doesn't really belong to the child. They wouldn't have taken it out of your father's disability. It would have been a separate payment from social security for his dependents. I would assume since your mother has been saving it, she wants you to use it for something important such as college or a down payment on a home.

There is no way to tell without reading your court order. Get a copy of the order and take it to an attorney. Free or low cost attorneys are usually available for low income people under "legal services". Look at the bar site for the state where you live and it should tell you this information or provide you with the phone number of your local county bar association. Call them, they will tell you where to go. (Even if you don't have the order, you can still see the attorney. He cannot legally tell your Mom what you talk about without your permission if you are not a minor).

Sounds like he is just filing to lower child support since you are 18. Your money is your money. It really has nothing to do with your money, claimed income or whatever. It just basically releases him from having to pay for you. Your money has nothing to do with anything. You are now considered an adult If you choose to help with the bills and live there that is between you and your mother. The court is not going to get involved and order you to pay. Yep. Something is fishy for the above reason. And the court does not call people. Things are filed and you GO to court and then a judge decides. And again they are not going to order you to what would basically be paying your own child support. You are being lied to.

My ex is on disability. As his child, my daughter receives 1/2 the amount per month, under my name, that he gets each month. It's not actually taken out of the money that he receives each month, it's a "dependents" amount, which all minor children of disabled parents are entitled to. If your mom put it aside and left it untouched for you, then that's great. Legally, she could have used the money for your care, rent, etc., or could have it earmarked for use to send you to College or something similar. Ask her what her reason for not giving it to you is. I figure that she has a good reason, she may feel that you are not responsible enough for it yet and wants to make sure that you don't just run out and blow it all. Ask her what's up? She is looking out for your future. That's part of her job as the "Representative Payee" of the money that was received and as your mom.

Actually, child support is for the mother/father to take care of the child. She is probably saving it for your future.
