I'm supposed to be moving in a single family home community (renting) and upon signing my lease I was told that the HOA would require me to get my finger printed from the police station. I'm working with Century 21 and they advised that thet conduct their own background check however, the HOA wont accept the lease without it. I called the HOA to verify and they advised that this was their rule.

The HOA can set up whatever rules it desires for renters as long as such rules do not violate federal and state discrimination and housing ordinances. There is no ordinance preventing a HOA from requiring a fingerprint on record.

A finger print on any type of contract is only being done to deter fraud. What I would be asking instead is if the lease documents you signed are being locked up and what type of background checks were done on the HOA members and how much indemnity insurance each HOA member carries. Those items will safeguard you.

They need to provide this documentation to you, the only two items they will have is the community's deed restrictions and by-laws, both are available for you to review, if they wont give you a copy contact your county clerk, they can direct you to where you can obtain a copy of these!
