i am HOH , I KEEP hearing since i make more i should claim him then i here since she makes less she should claim him. whats the CORRECT answer to this situation

It appears that you are in a gay relationship. Only one of you can be the natural parent unless the other adopted the child as well. Assuming that no adoption is involved, ONLY the natural parent can claim the child. If you're not the child's parent you can neither claim the child NOR file as HoH.

It's not an easy question to answer. It depends on how much each of you make. The earned income credit is based on your wages and other types of "earned" income. The credit goes up until a person earns about $17,000 (last years number), then it starts to go down. You really have to check the taxes both ways, with you claiming the child and with her to see how it works out best.
