Get DOCUMENTATION that the children are not living with the mother. Get the proof of who they are living with.
If the ex's parents are willing they can help your husband in court get custody of the children.

Get a lawyer and have lots of proof before going to court.
To get the kids might not have to be about the neglect.
An attorney will know more.

When choosing an attorney remember that the longer they can drag it out the more money they make so always stick to the fact and don't get into fighting with the kids mother.
It helps keep the case short and to the point.

If the children are really in the custody of the mother's parents, then your husband can go through the state to have the child support go to the parents since they are caring for the children.
The money IS to support the household in which the child lives, so this would be the parents.

He also stands a very good chance of getting custody of the kids, especially if the mother is neglecting them, having them live with someone other than her, and bringing them around felons.
Good luck!

I would start by getting a notarize letter from her parents stating that they have custody of the child how long they've had it and emphasize the fact that the mother does not provide financial support even though collecting C/S from the father. Then take it to family court. This will at least get the payments routed to someone who will actually use the money to provide for the child. Might even help dad get custody if he so desires.

Check how he is paying this support,it really should go through the court so there is a record,he should get anyone who witnesses the money being used wrong and get statements so that he can file a complaint and have proof.......file for custody of the children.......

Live with it. Or go back to court and try and get the judge to modify the divorce decree to get custody of the child. But chances of winning are very slim. It takes proof of neglect.

Unfortunately, the mother is never required to prove that she is spending the "child" support that she gets on the child. The best thing would be for your husband to file for custody of the child.

Fight for custody of the Child. Then go after her for child support.
