My husband is only being paid if he works on the holiday. This I don't think is right. He should be paid for 8 hours. Not 7 hours because he only works from midnight to 7 am!! Please let me know what you think!! If he works the holiday he should get paid time and a half.

There are no laws saying companies must honor any holidays.

And if a campany does have holidays, there is no law, saying they must pay people for being off work on those days.

Or pay people time and a half for working those days.

There is no legal requirement to have paid holidays unless your husband is working under a contract which guarantees paid holidays which it doesn't sound like his is. Paid holidays are usually considered a benefit of the job like health insurance, 401k, paid vacation, etc. No company or place of employment is required to give any type of benefit, but they usually do to attract and retain better employees.

I also believe that there is no legal requirement to pay time and a half for working a holiday unless this is stated in a contract of employment; however, this is a fairly common practice to encourage employees to work on holidays.

Most of the time, you have to define those as conditions on the contract that you initially sign when you begin work. If you did not, there is no law that guarrantees a temporary worker the same wage priveleges (paid holidays) as a permanent worker. Temporary workers are generally just paid per diem ( days of work). Ask your Human resources person for the answer.

Since you are online to ask this question already, go to your state's labor board site and see if you can find regulations.

If he is a state employee, there are probably laws on the books in his favor. If he is a full-time employee of a really small, private company, it is possible that no law applies to this case.

There is also the National Labor Relations Board (NLRB.GOV) that would possibly have regulations on the matter.

No..... Paid hiolidays are a benefit, just like insurance....the company has the right to decide whether to offer them.....
