No, he's not an Uchiha.
Sharingan is a Kekkai-Genkai (Bloodline Limit) of the Uchiha Clan. It can only be obtained if you are a part of the clan or if you had it transplanted into your eye from an Uchiha who was willing to give it up. (That's what happened with Kakashi's Sharingan).

No, only Uchiha's do, even Kakashi got his from an Uchiha, Yondaime is the one who made Rasengan anyway.
