I believe that the one who stays in the house has to pay the one leaving 50% of the house money.

Well, unfortunately when you get married everything is 50/50, including debts and assets. I was married for 4 years, now divorced, we have to split all of the debts. I am even paying 20 % of his school loan debt we had before we were married. Good luck to you!

The both of you are responsible for all marital debt. They can put a lean on your house if she does not pay her debt. If you jointly own it you would be responsible to get it paid. The only asset they will confiscate is what you put up for collateral. Borrowing money to support a 28 year old man? Why does he not support himself? Her borrowing money and not paying it will affect her credit.

prenuptial settlement is assents till now the marriage, no longer for the duration of. All debt for the time of the marriage is marital debt, to be chop up between the two events. My farther in regulation and my ex husband took a 8,000 very own loan out, i had no area nor did i even comprehend, i'll would desire to pay 0.5 of that alongside with all of my ex husbands costs. it somewhat is only the grotesque area of divorce.no person likes to think of approximately that as quickly as entering what's supose to be a existence time of affection and dedication. good luck to you, Jenn

Are these debts redounded to the benefit of her son only or it somehow all of your are benefited by it? Generally your propety will not be held liable for her debts because you are not obligated to support her son however, if it can be showed that you are likewise benefited from that debt in any manner, your community property will be liable for it, in case the community property is insufficient, you will be solidarily liable for the unpaid balance with their separate properties. But if such debt is solely for the benefit of her son, then your property cannot be held liable.

Why not jump on it and divorce her first and refuse to pay for any debt that has to do with her son?

Yep, that's what happens when you "sign up" for marriage, you get ALL the baggage that comes along with it. Consult an attorney.
