I filed a claim with OSHA about my place of employment being unsafe. I chose to excercise my right to remain anonymous. OSHA then sent a letter to my employer stating the allegations. However at the top of this letter, OSHA put the company name with my address under it instead of the company address, thus revealing my identity. I feel my rights have been violated. Is this grounds for a lawsuit or any other legal action? Please answer if you have legal background. Thankyou

It's a lawsuit only if something bad happens as a result of your complaint.

I am not sure where you are located but it is my understanding that there is no "privacy clause" with OSHA. I've taken quite a bit of OSHA training as Safety professional and have seen the question come up.

When OSHA arrives on site at an employer's address, the employer is allowed to know exactly why OSHA is there. If there is an accusation that something is unsafe, the employer has the right to know who the accuser is. This reasoning is pretty simple and it isn't designed to fire the employee or harrass them it is so that the employer can find out if the issue was ever addressed to them from that employee.

Now. If the employer suddenly fires that employee or creates a "hostile work environment" then the employee most defninitely has a case, especially right after an OSHA visit. And most cases of this sort are won unless the employee has an extensive record of misconduct in their employement file (which, by the way, you have the right to ask to look at at any time).

Just some thoughts on this. It also may have changed since my training. As I work in a government position now, I admit I haven't kept as polished as I should concerning this kind of law (government agencies are typically exempt from OSHA oversight).

This sounds like a mistake on the part of OSHA, in as suming that your address was the address of the company you complained about. There was probably no attempt to reveal your identity, but more of a difficulty or mix up on the address. You would have a course of action if the mistake has an impact on your employment. You would be required to prove financial damages.

I have no legal background bu tr that this a simple question. Yes you have a suit but only if the letter OSHA sent has a negative impact on your working environment.

Contact an attorney. Most of them will do a free conseltaion. Then if they take the case and feel they can win, especially with a BIG company like OSHA, they will take a persentage of the winning of the suit or not get paid. so it cost nothing for you to it out of pocket. you have nothing to loose and only things to gain...Go for it and gl.
