We need more information than this. For example, if you are not paying your rent the landlord is probably justified in kicking you out. However a lot depends on where you live, so I would check with the housing department or something similar in your city. Find out *why* he wants to kick you (or whoever it is) out, and see what somebody at that place says. But in short, yes, there are lots of legal reasons somebody can kick a person out of his house during the winter.

Depending on whether the person is just living with you or renting a property you own and breaking the terms of the lease, how long they've lived there, and depending on where you live, there might be laws requiring a certain amount of notice to kick them out, often 30 days. You probably can't just dump their stuff on the front porch or lawn.

Are you a landlord asking about moral scruples or a tenant worried about the cold.

Working or not dependants or not, one who does not pay rent can be kicked out.

If the landlord chooses to let him stay rent-free because of the winter, that his business, but he would be well advised to have a lawyer draw up an agreement, stating the position.

If they pay you rent, yes it is. You must give them a 30 day notice. If they live there and contribute in any way, the same rule applies. If it's a friend for a few days...kick their butts to the curb. If it's you they must give you notice. If they are not on the lease they can go.
