Ok, so ive worked at subway for about 5 and a half months now, and we just got a new mananger about 3 weeks ago. There are like 7 other people who work there, but only about 3 people work at one time(in a day). At the end of the 2nd week that we had our new mananger, $30 dollors went missing. So everyone working that day had to pay $10. We only have one register, and before we ring someone up, we have to put our own number into the computer, so that we all know who was on the register. We have 3 cameras above the register, and 4 around the store in other places. But what i dont get is why we have cameras if they cant look back to see who took the money??? We just automatically had to pay?? Im 17, making $6.60 an hour, so thats an hour and a half of my time, just given to thm because someone else stole some money,... i cant see that being fare. $10 might not seem like much, but is that not crappy that they have 3 cameras but wont even look to see who really took it?What should i do

Unless they can prove that you stole the money, they cannot force you to pay anything. And they cannot dock your pay for it either. They are trying to railroad you and your fellow co-workers. What has happened is that someone has lost or stolen $30. They will either have to investigate who did it and punish them or fire all of you for being careless.

If they do decide to fire you,they still cannot get any money from you unless they sue you and prove in a court of law that you took the money or it was your negligence that cause the money to be missing.

It really sounds like you have a young, overzealous manager that is afraid that he is going to look like a fool to his superiors if he doesn't get the money. Don't back down from him because he will keep doing this to you and he will start to take other liberties with you and the people you work with.

Also, contact the Department of Labor for you state and see what he is allowed to do as firing you may not be an option either if he has no proof that you were responsible for the lost cash.

I had a similar event happen to me but it was a lot more money and I lost my job.
What I knew before loosing my job was that the cameras in the store were there for display only. I was working night shift in a convenience store and just started checking it out cause I was working in a "bad" neighborhood. To say the least I was very surprised because there were cameras everywhere but not one worked.
I got a call late one evening from the store manager accussing me of stealing over 1000.00 and that I was going to be arrested. Lucky for me the owners finally figured out it was the manager doing the deed but none of this would have happened if those cameras actually worked.
I would ask to see the tape from that day and if it can't be provided then I would really consider finding another job and I would not "give" them money you earned because if they can't show you the tape then they just "stole" $10 from you.

I don't CARE HOW many cameras they have, how much MONEY is missing, or even WHO took it.

It is against state law for an employer to DOCK an employee for missing money, tools, or equipment UNLESS the employee has been given ABSOLUTE control over that item.

IF you were the ONLY person with a KEY to the register it is STILL illegal for the management to dock your pay. He can accuse you of theft and stand the storm if you decide to sue him for improper dismissal (no actual evidence of the theft, only a suspicion) and prosecute you in court (level of proof needed is quite high) but he cannot dock your pay.

Tell the manager that what he is doing is ILLEGAL and that you want ALL of your docked money back IMMEDIATELY. Any delay on his part and you will go to the State Labor Board and report it AND file a grievance to get the money back.

DO NOT let him give you some song and dance about your loosing your job or ANYTHING else. Remember, HE TOO has a boss, one who is responsible for seeing that any action of his employees (especially the manager) does NOT tip the boat over. A report of this type (improper docking of an employees pay) will CERTAINLY be of interest to the State Labor Board.

Also, DO NOT concern yourself with WHAT happens to the other employees. Your concern is ONLY about YOUR wellfare.

Good luck. And DON'T be a wuss about this. Go in and hit them high and continue to hit them high untill you get your money back.

In every US State this is illegal.

When you go to work tomorrow tell them to give you back your $10, and if they don't you'll go to the labor board.

I'd also contact the District Manager and make sure he knows that his store manager is breaking the labor law and potentially exposing the company to all sorts of fines and penalties.

I would also, of course, be looking for another job.

Well, in the UK (and it seems in the US) that's illegal; they need to be able to prove who was responsible for the loss, and recover that money, either through an informal "fine" if that's permitted in the terms of employment, or through legal action.

Sounds like your new boss is incompetent and is trying to cover up the fact that he doesn't know what to do.
