I have already filed a letter of non-receipt with the company and they have told me that the claim is pending with the shipping company. I think that the company should issue me a refund and the claim with the shipping company should be resolved between them and the shipping company since I did not get a choice on shipping. I think over 3 months (I purchased the item mid-Aug) is a pretty lengthy period for a refund for an item I never received in the first place. Does anyone have any advice of what I can do at this point? The company is legitimate, they are not a fly by night, but obviously their customer service is horrible.

IF you paid with a credit card, call the c/c company and tell them.If you paid cash call the better business bureau.

well, the legal issue is that, even if yo udidn't now it, you took delivery of the tv when it was loaded onto the truck.

So technically, i tis between YOU and the shipping company, but the company seems to be stepping up.

I agree, talk to your cc company, they will refund you and deal with it.

Alternatively, look into your homeowner's insurance, since it was yours when it left the store.

Go get an attorney.
There are numerous legal remedies available to you.
