I ask this question because I got an offer letter from a company in November 2007 which indicated that the job will commence on January 3rd, 2008. And I signed the offer letter. Today, in December 2007, I received another better offer which the job will commence on January 2nd, 2008. I prefer the second offer which will start on January 2nd, 2008. But I want to keep the two offers available at the same time. Because I am afraid if I cancel the first offer right now, and the second company cancel their offer after, I will not have a job . So I wonder if I can give the first company the cancellation notice on January 2nd, 2008 after I start my new job in the second company. Do I have any legal obligations to obey the first offer letter? Can I just send a email to cancel the offer letter?

it's not a contract, it's just an offer letter. I just wonder if there are no obligation for both side to follow the offer letter, what is the offer letter for? I heard about someone got an offer and resigned from the current company and then was dumped by the new company, at last he had no job.

Unless you signed a CONTRACT you can still turn an offer down. Offer letters are exactly that: an offer, nothing more, nothing less. They can also cancel it too though.

I would try to get in touch with them to turn down the offer in the same manner you received the offer rather it be email or snail mail.

You probably can cancel on the first job, if it wasn't a contract that you signed. But it would be professional to do it now, rather than wait.

If the second company is going to dump you, they could do that anyway on January 4, so you aren't really protecting yourself from anything by holding off telling the first company you aren't coming.
