He was abusive to me and I have moved to another state. There is no contact at all

See a judge about a legal name change. There are some forms, a fee.... and a waiting period... then, Voila'! Name changed.

Check with your local court where you obtain a copy of your birth certificate and they can tell you everything you need to know. I'm not married and both my kids have my last name. There is no law that says the child has to take on the man's last name, even if he signs the birth certificate. Get the name change, but you will have to deal with the "where is my daddy question" down the road even if you do change your child's last name

You just need to apply to the births deaths and marriages registry (if in australia), fill in the forms and pay the fee. You will be issued with a new birth certificate and change of name certificate. Because his name is not on the birth certificate, there should be no problems.

If the fathers name is not on the certificate and yours is the only name on it then legally the childs name is yours already.

Contact the superior court in your area and ask the procedure for a name change for a minor. Make sure you tell them you don't want it published because you are a survivor of spousal abuse.

I'm so sorry! i know that's hard to go through, but the legal process should be a piece of cake, since he's not listed as her father.

people change there name all the time. The people at your nearest court house could probably tell you the proper procedure.

it all depends on the state you live in - but you will have to file legal paper to "amend" her birth cert.
