My friend had an auto accident nearly two years ago, the lawyer had him sign two checks for 25 grand each two weeks ago, they had to be endorsed by two parties by the way. He has'nt been able to get a hold of the lawyer all week, and won't return calls.

File a disbarment case against the lawyer for negligence to serve the client so that appropriate penalty will be meted on him.

So he signs the checks and the checks must also be signed by two additional people, that can take a lot more that 2 weeks especially in the holiday season. WAIT A MINUTE, if there is multiple endorsements these checks will probably need to be put in the lawyers escrow/iotla account, the amount clear via the banks, and then checks cut out of this account to be sent to each endorser. So you have time to get each person to endorse the checks, time to get the banks to send the funds from one bank to another, and then time for individual checks to be cuts from the escrow account to the individual endorsers. I would be surprised to get all this done in four weeks.

Ever think that one of the endorsers, or the attorney could actually be on a vacation that was not planned around your friend getting his checks. Either of the other two people who need to sign could be out of town. The lawyer could be out of town at another trial. While every client loves to think that their case is the most important case in the attorney's entire life, the reality is that it is not and all other cases need to be attended to.

Have your friend leave a message and Lighten up!

Contact the Bar Association of your state and report the situation.

*a week is more than enough time for us attorneys, held to the highest standard of client relationships, to get back about 50k in signed checks on a personal injury action. If he is doing something unethical, its better to act on it now than wait like the one person is inferentially suggesting.

He's filing a complaint for this? His kid may be in the hospital, he may be on vacation, he may be at trial.......

Please. NO one is going to consider 3-4 days of unreturned calls actionable.

TRY GOING TO HIS OFFICE...

That's a little drastic for only a few days. Go to his office.
