I have contacted the branch i worked at but they don't seem to folow it up. Where do i stand legally?

I am reminded of a friend of mine who went to close an account that he thought had about $15 in it. The teller said, "do you want all of it?" He replied how much is in the account? She said, "$310." He shook his head and said he thought a mistake had been made. She check over the account and finally said, "You are right, it is $330." At that he nodded and said, "That's what I thought." He took the money across the street to another bank and opened a new account. The point is, try and do the right thing. Don't kill yourself doing it. Also, how can I get a job there?

What a great pity that the first decent answer you were given by 'wizjp' got the trolls thumb down. The bottom line is that if you didn't make an attempt to return the money you could be guilty of theft. The offence of theft includes circumstances where you innocently come by property that isn't yours and then proceed to assume the rights of the true owner'. In this case spend it. You have been correctly advised to do your best to inform the people who made the mistake, which you have apparently done, You must not spend it but if you put it into a seperate account it will be there if they ask for it back. Most legal opinion also believes that although you have to give the money back you are actually allowed to keep any interest that the money earns in the account so you will get a little bit back for your honesty.

Anyone who tells you to spend it or not to worry about it doesn't know what they are talking about. Governments keep meticulous tax record and corporate accounting offices always correct their errors. It WILL eventually catch up to you. Do not cash those checks or touch that money until you see in writing that it is lawfully yours. If you spend it you will regret the day you get that certified letter explaining you were overpaid and hey could you give it back. Better yet, if you did not earn it, just send it back.

Legally the company can ask you for it back , once they get organised and notice the error , But if as you say you have been trying to get them to sort it out then morally they are on dodgy ground and even if you offer to pay back at a very nominal sum they should really accept .
Make sure you have documented proof of your attempts to sort it out , like dates /times of phone calls and any copy of correspondence .

Write a letter to them to give you an explaination of why you were paid this money.

State in the letter that you wish to have a response within 14 days.

Then say that if you don't get a reply within 14 days that you will claim the money.

Write a certified letter to the HR department. Just make sure you have not spent the money, eventually they will catch up and want their money all at once.

Write a formal statement showing the overpayment, send copies to your boss, your HR and payroll departments and advise them they need to correct the overpayment within 90 days. Escrow (put the funds in a seperate bank accoutn) and see what happens.

You will have to pay it back unfortunately. You would take them to a tribunal if they made illegal deductions. Have a chat with the C.A.B.

spend the lot!!! then when they catch up just say you didnt realise as you never check your account and then offer to pay £5 per week
