A month ago I received papers from my ex-husband to modify parenting time. A couple days ago I received a court order stating due to my failure to appear, I admitted the allegations, and that the relief requested in the sworn affidavites would be granted. When I received the motion, the pages skip from pg 1 to pg 3, the first page being point 1 what was already ordered and point 2 that the current arrangement isn't in the best interest of the child. Page three is my ex-husbands signature swearing that the facts included are true. That being said..I never requested relief from anybody and I don't even know what it is i supposedly asked for. Because of this i now have my time with my son changed from Sunday thru Thursday to everyother weekend starting in Jan. i'm currently unemployed with 2 other children and don't have an attorney like my ex and can't afford to get one. Is there even anything I can do to change things so that i have more time with my son since i NEVER asked for relief?

my ex-husbands attny's wife is the person that notorized abd served the motion papers. i never received a copy of the court date or time. my ex's attny wouldnt return my calls when i tried to ask him and my ex kept telling me he'd "let me know when he found out" and that he was taking care of it.

it looks like you both had joint custody and now you have visitation, because you didnt show up it went in favor of your ex. , try legal aid, when your ex served you with papers, was the whole thing together,or was the missing papers the motion the judge sent? on the papers your ex served you with was their a court date ? if you cant get legal aid, go to the court house and ask for a modification of visitation packet, fill it out and write down what you want and why . it might be good to speak to the judges secretary and explain what happened. if they wont listen you have to take it back to court

You could start by going to the court clerk's office and telling them the problem. They may be able to tell you what paper you need to fill out to get the situation addressed by a judge again.

If, by any chance, there's something about the partial papers you aren't understanding correctly (like how they came to be) maybe the clerk's office could explain that.

Call the court and see why you missed the court date. If need be, get a court appointed lawyer to help you.

My suggestion is seek legal advice. Something went wrong here and you missed a court date.
