If my boyfriend is living with me and he is not on the lease, and the lease agreement says that i cant have any guest living with me and they send me an eviction notice, if i marry my boyfriend can they still evict me?

They can evict you in CA, marital status does not give you rights to avoid a lease agreement.

Just put him on the lease. This is not that hard to figure out.

Tell them about your boyfriend living there. Many rents don't change by number of occupants, though utilities you pay through the lease agency might. But, why risk getting evicted. If you marry him, he isn't a guest, but you need to report the extra tenant to the leasing agent still, or they may still have grounds to evict.
If you have already gotten the eviction notice, I suggest you start looking for a new place to live. You did break their rules after all.

I am not a lawyer. Is there anything in the lease about your getting married? If not then you may have to renegotiate your lease, but LISTEN and take a word of advice from an old fart. Don't get married just so that you can keep your apartment. Depending on how long you've known him, get another apt. with both names on it. Then after you've been together for a while, you will be better able to determine if you two are compatible. Don't get married for the convenience of keeping the apt.

Definitely read the lease. I am willing to bet you find a no sub let clause in your main agreement. This being the case, Kick them all the hell out. And start over. You might want to teach the person who is not paying an object lesson. His belongings in trash bags put by the door.

If that's how the lease is worded, than yes, they can evict you or make you put your boyfriend on a new lease.

Wouldn't just be simpler to add your boyfriend to the lease?

They can - but they won't if you tell them you're married - and show some proof. The idea is to prevent five illegal alien families from moving in to a one bedroom apartment.

add him to the lease that's what i did when i found myself in your situation
