I suing my ex because he agreed to pay me but has not. It's been hell since I met him and he wont go away.

Are you saying you're a typical liberal trying to sue someone for every penny they have because they called you a name?

Generally you can't get anything for emotional distress. Small claims courts aren't set up to handle that sort of case. If somebody owes you money, you can get that. I believe that in some jurisdictions you can get compensation for legal fees, but that's it.

PS: Small claims court doesn't use juries. There's only a judge.

Zero.

Small claims courts can't award emotional distress judgments. Also, not paying someone money that you owe them doesn't meet the legal definition of "intentional infliction of emotional distress" anyway.

If he owes you the money and hasn't paid you can sue him for it, and for the small claims court fees, that's all.

you don't have a case for emotional distress... if he promised to pay for something and you have proof sue him for that ! small claims court is limited to $5000

Hopefully, zero. In my county, small claims only applies to services or goods and the costs of these. Would have to file a civil suit to get damages beyond that.

If I'm on the jury it would be zero.
I would vote only for "real" measurable damages
