OK well before i met my husband he had an ex girl friend who lets just say fell from an ugly tree and didnt miss a branch...well while she was living in home off his income he later found out she was having sex with 7 other people. well she got pregnant. come time for that baby to be born she left the name on the birth certificate blank for the father...well she realized mc donalds wasnt going to get her ahead in life with a child so she went to court and said my husband was the father...which makes sense cause he was the only one with a job that could pay child support...well she had the court date set up while he was out of town for work he knew nothing about the court till he got back. and since he didnt go to court to argue the fact he dosent believe that child is his they deemed him the father cause he didnt show up for court. well my question is how the hell can we do this? we have went through lawyers for 2 years to find out how to make her do a paternity and no one will help us

i guess what i really need to no is how do we force a dna test if they keep giving us the run around....i cant believe it was even legal to deem him the father without a paternity test...this all makes my head spin...any advice would be great...the thing is they never even set up visitation. so hes been paying for a child for 2 yrs that we are sure isnt his and cant even see him....youd think once they made him pay childsupport he would get visitation...i no its all weird but i almost think this whole thing was set up with his ex and someone on the inside stuff just dosent messure up

callawak if you read what i wrote you wouldnt be so rude...so try reading it or here ill sum it up....he was out of town working had no idea of the bs she was puling found out when he got home we didnt keep him from my kids i love children his kid or not he would of been there for the kid till paternity was established she wants the money but dosent want the kid to have visitation...so none of this was his fault and to answere another question i live in nebraska and yes i think the way this was handled was messed up i have never heard of it being handled like this before

You have the right to a DNA test. DO NOT let anyone tell you otherwise... Oh and BTW If she slept with 7 other guys SHE could've been ugly BECAUSE NO MAN WANTED TO MARRY HER........does that make any sense???
Good enough to see in the dark but not so good to wake up to every morning...LOL

If you contest the paternity, the court will and should order a DNA test. They do this stuff all the time. He needs to show up, get it over with and move on. If it is his child, then I'm sure he'll have no problem providing financially, but there'll be the issue of custody, etc. There is a way, if he's proven to be the father, he can sign away his paternal rights and get out of paying child support period. I don't suggest that because then his child will suffer the ignorance and the poverty of his/her mother. You can also file for full custody, I don't know how comfortable you will be with that. But then, if he gets custody, you guys can request child support from the mother...Good luck!!!

ah the old out of town court date. well thats very common for women to do, trust me, i used to work in a legal office and this happens constantly. first get a lawyer (female perferably) and go to court and order a paternity test, once the paternity test comes that he isnt the father all child support is dropped. it would also help him show that he was out of town and for what purpose (best off being a business related)

I don't think your getting the truth on it someone isn't telling you something but i do know the courts can do that if he don't show up and if they were married I would try writing a letter to the court requesting a paternity test and if you can get the names of other men she was with to send also, someone might look at it. It's worth a try,good luck to you.

My question to you is can you make contact with this child? There are home dna kits that you can buy online and get a dna sample discreetly. You can either do it through saliva or blood. You can use the results of these tests to prove your case in court. Hope this helps you out!

The court will order a DNA test if the paternity is contested. When your husband is in his court date, he can ask the judge to order a paternity test. It will be scheduled within a few weeks, and results a couple of weeks later.

If negative, this story is over for you.

If not..... well.......

EDIT why are we all getting thumbs down? What we are saying is true. Unless she will consent to a DNA test you will need a court order.

You need to get back into court and get that paternity test done. Set up a visitation schedule at that point also.

When the test comes back you will know, as will the court. You will need an attorney to handle it for you.

You need to call and find an attorney in the area she lives in like another poster mentioned. You need to find an attorney that is very familiar with this you may have to go through the yellow pages under family law attorneys in her area to find one. Describe what it is you want. Most large cities should have 50 or so that handle family law. You only need to find one but the right one. If you describe your situation to the attorney up front like you have here you should be able to find 1. Clearly not a fun task. Good luck.

does anyone he knows ever see the child? they could get a sample of dna from the child, and he could get his own paternity test done. it's sneaky and behind everyone's back, but it may just work.

otherwise your going to have to prove that she wasn't only sleeping with your man. even if you only get 1 or 2 of the other men to testify would be great.
