Officially it apparently is a fruit, something to do about it seeds.
However I see it as a veggie, I dont eat it as a dessert which is what most people see the fruits ending up.
I don't know who makes the rules and regulations of the fruits and veggies, but does it really matter, both of them are just going to be food some time during a meal. Your choice, eat it whenever you want.

In 1893 , the Supreme Court ruled that the tomato must be considered a vegetable, even though, botanically, it is a fruit. Because vegetables and fruits were subject to different import duties, it was necessary to define it as one or the other. So, tomatoes were declared to be a vegetable given that it was commonly eaten as one. (Source: The Packer, 6/9/90)

It's a fruit as it contains seeds, as is a cucumber, marrow, courgette ...... the list goes on.

And I don't care what some stupid judge in the US Supreme Court said, you can't change the classification of something just because of how it's eaten.
