How old is the man? Molestation is forced and hostile.If she is willing I would not call it molestation. In most states the age of consent is 16 or 17. It can be looked up, type in legal age of consent. It is listed in alphabetical order by state. All of the different countries are on one of the sites also.

In the United States. Rape is considered sex without consent of both parties I suppose. The legal age for consent is 17. Any sex had between a couple where one member is 18 or older and the other is not yet 17, can be held in court as rape, and is highly frowned upon. So yeah if your friend is having sex with a minor and anyone says anything to the wrong person, an investigation will be held, and rape can basically be charged without real evidence. However Love is love. If they truly want to be together. And have it be legal and not dangerous, your friend needs to keep it in his pants until his girlfriend is 17.

Molestation refers to a child under the age of consent. In the USA the age of consent differs from state to state. In 50% of the states the age of consent is 16. Only 5-6 states actually have the consent laws at 18.

The term is not child molestation...it's statutory rape. And, in most states, the age is 16...sometimes younger, possibly sometimes older. Child molestation generally applies only in the case of younger children. Yes, it's different if she's 17...but, to whom? In the eyes of the law, yes. But, morally...not so much. You didn't say how much older he was. But what does he want with a much younger girl? He wants someone he can manipulate and take advantage of. And what does she want? Most likely, she has "daddy issues", like Lindsay Lohan and a lot of other girls who behave in unhealthy ways with much older guys. This is almost certainly NOT a defensible relationship. And there may be many things that could happen to the guy, from loss of a marriage or other relationship, to shunning of various kinds (including loss of jobs, etc). There COULD be legal consequences, but probably not...since she's almost certainly over the age of consent.

How old is the man involved? Chronologically she is still a child at 17, legally as well. Could be she's looking for a father figure and who knows what he's looking for. I don't think it's technically molestation as she's old enough to say no, but I don't believe it's ethically or morally right.
I really don't believe that older adults (men OR women) should get involved with someone that much younger than they are.

In Australia if the male is over 18 he is in a world of legal trouble a guy I know just got sent to Ararat jail for 5 to 8 years for the same thing

No, it's still child molestation, and the man can be convicted and have to register as a sex offender for the rest of his life. Some states make exceptions for couples where the age difference is small (like a year or two), but for a larger age difference, underage means child.

Where I live the age of consent is 16, but I always feel a bit creeped out by men who date girls that are young enough to be their daughter, to me that is too big an age gap when the girl is still in her teens.

The man is a sexual predator of young teens and deserves what he gets. The girl is old enough she should have said no. One person said "who the hell cares?" The law cares and it is a punishable offense.
ZCT: You need to read that chart again. Nowhere does it say anything about a person being over the age of 18 being with a younger person. The maximum age is 18 years of age. The question was an older man.
