I am a mother in California with not so much as a ticket on my record. I am a well educated chemist and in the process of divorcing this man. He was convicted of domestic violence against me while our 3 yr old son was in my arms. He also has been convicted of possesion of a controlled substance and intent to sell both felonies. As well as multiple DUI convictions. Also he is pending deportation for these crimes. Yet even with my attorney I can not get the county to take his custodial rights away. I know it seems insane, right??? Any suggestions???

You live in Califonia --- no one is accountable for anything --- OJ, Robert Blake, Phil Spector, Paris Hilton, Lindsay Lohan --- are you suprised? What your X did is nothing in California.

this isn't enough to have parental rights stripped. i know you think this sucks, but you have to look at it from a legal standpoint. his drug problems are drug problems and fixable with time if he wants to fix them. the DV was against you, not your son. if the son was harmed, more then once supervised visitation would be advisabe to request on your behalf. everything you mentioned doesn't fall under reasons to strip a parents rights. just because YOU don't want to deal with him (trust me, i know how you feel). he is still entitled to visitation. there are so many things you can utilize to protect yourself and your son. supervised visitation, police station custody exchanges, a third party monitor.

your son's life would have to be in danger to have his rights stripped. or he could voluntarily do it if a new husband of yours was willing to adopt your son.

but to do it...just because it will make your life easier...it can't be done. and if any attorney tells you otherwise, they are stealing your money and wasting your time.

It sounds like your attorney is not working for you and time for another, better attorney. I will give you another resourse as well that may be able to help you but there is no reason that he should have visitation unless it is at your home or a neutral place. Good luck to you!!

I'm sure you can make it work that your child lives with you. If you can show the chance that he could flee with your child or endanger your child you could limit contacts to requiring supervision.

Welcome to California, a state under attorneys & judges. That interpit the regulation in accordance to their expertise. They make victims in control of being victims & perpetrators benifactors of our civil rights. would God help us!!!
