charged with assault for throwing a snow ball at a colleague-surely this is the law gone crazy?

Surely this case doesn't stand a snowball's chance in hell of going anywhere against the Aussie. Sorry, that was too tempting to pass up. You're right, the laws are crazy.

The crime of "assault", under common law - so it's true in Australia as well as in America - doesn't actually require contact at all. Adding the "snowball" to the mix actually adds the crime of battery to the potential charges.

Remember, this wasn't a case of a 'friendly game' that led to charges. Thistleton, and two other adults, were harassing and taunting the girl as she went to the bus stop because of problems they'd had at work, and as she tried to get away, Thistleton hit her in the back of the head with a chunk of ice.

Assault charges are perfectly justified here, and the same circumstances in Oz would almost certainly have led to the same charges - and quite likely to a battery charge too.

Thistletons lawyer is the one characterizing this as just a "snowball" - but it caused actual injury, and was thrown with malicious intent.

Being charged and going to court are two different things.The law allow law enforcement agent to arrest and hold someone for seventy two hour on suspicion of a crime.

It isn't the law that is the problem, it is the people. If you assault someone then you should expect to be charged with assault.
