The crime of "assault", under common law - so it's true in Australia as well as in America - doesn't actually require contact at all. Adding the "snowball" to the mix actually adds the crime of battery to the potential charges.

Remember, this wasn't a case of a 'friendly game' that led to charges. Thistleton, and two other adults, were harassing and taunting the girl as she went to the bus stop because of problems they'd had at work, and as she tried to get away, Thistleton hit her in the back of the head with a chunk of ice.

Assault charges are perfectly justified here, and the same circumstances in Oz would almost certainly have led to the same charges - and quite likely to a battery charge too.

Thistletons lawyer is the one characterizing this as just a "snowball" - but it caused actual injury, and was thrown with malicious intent.

That colleague pressed charges that is all. In America we all have rights, and rather all laws are based on safety and breaking the individual freedoms or intruding on them. As with him throwing snowball why did he do it in the first place if his colleague didn't agree to it, like the person said before assault and be expected to be charged on assault.

America is a free place with opportunity (with the right expertise and education mind you) where money can flow like water. Break the rules and expect the system to break you.

The crime of "attack", under trouble-free regulation - so it is real in Australia as properly as in u.s. - would not surely require touch in any respect. including the "snowball" to the blend surely provides the crime of battery to the flair quotes. bear in recommendations, this wasn't a case of a 'friendly activity' that delivered approximately quotes. Thistleton, and a pair of different adults, have been harassing and taunting the lady as she went to the bus stop with the aid of fact of issues that they had had at paintings, and as she tried to get away, Thistleton hit her in the lower back of the top with a bite of ice. attack quotes are completely justified right here, and the comparable circumstances in oz..might merely approximately even have delivered approximately the comparable quotes - and very probably to a battery fee too. Thistletons attorney is the single characterizing this as merely a "snowball" - even if it led to actual harm, and grow to be thrown with malicious reason. Richard

It isn't the law that is the problem, it is the people. If you assault someone then you should expect to be charged with assault.

He could have had rocks or a large amount of packed ice in it, and that can really hurt, and cause some injury.
