The Supreme Court is chartered for 9 justices. The theory is, that there cannot be a tie vote.

I'm really not that familiar with this august institution, but can't ever recall of having heard of a tie vote; very possible that I'm wrong.

In an ideal world the best jurists in the country would recluse themselves if they had prior involvement with a case before them or in some way might be biased, but in our corrupt judicial system, the Supreme Court rarely if ever does that. Therefore, a tie couldn't occur. Their extreme hubris prevents them from being so honest. They get their jollies over violating the rules they enforce on other "lesser" judges.
