I was with my cousins at a popular city park at peak tourist season. My uncle tends to say the most obvious things. He noticed a couple of Muslim families nearby who looked like tourists. He announced 'there's a lot of tourists here.' The Muslim families heard his comment and thought he said 'terrorists' So thinking they were being discriminated against, they called the police. My uncle was charged for shouting racist insults. We tried to convince the TOURISTS but they didn't understand what had really occurred. The police officer didn't believe us.

Tourists and terrorists sounds almost the same. Thus, your uncle cannot be charged of the simple offense of insulting persons.

No, there is a thing called freedom of speech. Since he didn't try to incite a riot or call for a lynching of the people, he has to right to speak his mind. Just like the Nazis marching through Jewish neighborhoods.
